These Terms & Conditions ("Terms") govern your purchase and use of products and services offered by

ESP ("we," "our," or "us") through www.espmouthguards.com ("the Site").

By placing an order or accessing our Site, you agree to be bound by these Terms.

1. Pre-Order and Production Reservation

Purchases made through ESP that are labeled production reservations, Buy, order, or pre-order unless otherwise stated.

• Your payment secures a limited pre-order at a special, one-time discounted rate.

• pre orders and product reservations cannot be canceled after reserve/purchase.

• Products are scheduled to begin shipping approximately 90 Days after our goal of {500 orders} is met..

• you will receive product 30 days after 90 day production campaign end date.

• We will keep you informed throughout the process via email updates regarding development progress, milestones,  and estimated delivery timelines.

2. Payment and Pricing

All prices listed are in USD. We reserve the right to change pricing at any time. Payment must be made in full at the time of reservation.

• By placing a reservation, you acknowledge this is a pre-manufacture purchase and may involve a delay in fulfillment.

• Discounts applied during pre-order / Production campaigns will not be available after product launch.

3. Shipping & Delivery

if we have not started shipping product {30 days} after the {90 day} campaign end

then a refund may be requested or wait, guaranteed to receive product.

We ship internationally. Shipping times and costs vary depending on location and will be calculated at checkout.

• Estimated shipping timelines begin after the production milestone is reached, not at the time of order.

• ESP Mouthguards is not responsible for delays caused by carrier issues or customs inspections.

4. Cancellations & Refunds

If your order has not started to ship within {30 days} after the goal has been met {90 day production reservation campaign end date} -

you can request a refund or wait for you're guaranteed to receive product.

• Once and before a unit has shipped, all sales are final. after (30 days) of receiving your ordered unit We will not accept returns on shipped items unless required by law or damaged/ faulty.

5. Product Disclaimer

Our (MouthGuard) product utilizes embedded technology to monitor vitals and deliver audio through bone conduction.

• It is not a medical device, nor is it FDA-approved to diagnose, treat, or cure any health condition.

• Users are responsible for proper and safe use of the product.

• ESP Mouthguards is not liable for any injury, discomfort, or damage that may occur through misuse, improper fit, or device malfunction.

6.User Responsibility

• By using ESP products, including iMouthGuard, Smart Case, and coaching systems, the user agrees to:​​

• Follow all provided instructions for proper use, charging, cleaning, and storage.

• Regularly inspect the product for wear, damage, or malfunction.

• Understand the data provided is not a substitute for professional medical advice.

• Avoid misuse, such as using the product while damaged, altered, or outside intended conditions (e.g., extreme heat, water immersion unless rated).

• Assume responsibility for any consequences resulting from improper use or interpretation of features, alerts, or app integrations.

• Failure to comply with these guidelines may void any future warranty or support eligibility and limits liability for ESP and its affiliates.

• No Warranty (For Now):
  At this time, ESP products are sold without any warranties. However, we are exploring warranty options in the future, which will be clearly outlined when available. In the meantime, users are responsible for proper care and usage.

6. Intellectual Property

All branding, product designs, logos, and content on this Site are the intellectual property of ESP and may not be copied, used, or reproduced without permission.

• Customers must provide accurate shipping information. Reshipping due to incorrect address will incur additional fees.

• All sales are final. Refunds are not permitted except as required by applicable consumer laws.

• Eligible replacement items will be issued at ESP’s discretion after verification of product condition.

• Customers outside the United States are responsible for ensuring that product use and import complies with local laws.
